A south Minneapolis man has been charged in the Saturday night fatal shooting outside Ichiban restaurant in Edina, Minn.

Kayvon Julian Breaun Madison, 21, has been charged with second-degree murder with intent but not premeditated.

Charges say Madison was one of the people who reported the shooting and told 911 that he shot someone, and the person “came at me.”

The Hennepin County Medical Examiner yesterday identified Darien Jamal Roberson, 23, of St. Paul as the decedent in the shooting.

Charges say when responders arrived, they found Roberson down in the parking lot shot in the face and in the chest. He was pronounced dead at the scene.

The complaint describes that both Madison and Roberson were at the restaurant for the birthday party of a mutual acquaintance with several other people and were known to each other from past contact. Witnesses told police that the two had a prior dispute over a friend of Roberson’s who previously died of an overdose.

The parking lot altercation was captured on video. Charges state that the video “does not support the Defendant’s claim in the 911 call that D.R. came after him.”

The video shows that after the birthday dinner a group of five males left the restaurant in close proximity to each other. Madison and Roberson were two of the five males in the group. In the parking lot, some pictures were taken, including a picture where Roberson was in the picture with others and Madison was the person taking the picture. Pictures were also taken where Madison was in the picture with others, and it was Roberson who took the pictures.

After the pictures were taken, Roberson began to walk away as if to leave. His back was to Madison as he began to walk away. Madison then began to move toward Roberson and appears to say something to Roberson as he moves toward him.

According to one witness, Madison made some comment to Roberson about if Roberson’s friend had made better life choices, he would still be alive. Madison and Roberson then both took steps toward each other and were engaged in a verbal dispute. According to the one witness, Roberson told Madison he did not want to talk about it, but Madison kept pushing the issue.

The video shows that at one point during the dispute Madison raised his hand and put his finger in Roberson’s face. In response, Roberson slapped Madison’s hand away and took a step away from the Madison who then pulled out a gun and shot Roberson five times. Upon being shot, Roberson immediately fell to the ground.

Bystanders detained Madison.

Roberson was shot once in the left cheek, once in the left side of the neck, once in the back left of the neck, once in the left shoulder, and once in the central chest. Five discharged cartridge casings were found at the scene, the complaint said.

Madison remains in custody on $1 million bail and is scheduled to make his first court appearance on Thursday.
