Felon repeatedly spun through MN Courts revolving door now facing federal gun charge

Marcus James Malibiran, 23, a perp we’ve previously posted numerous times, has finally been charged in federal court after Minnesota Courts repeatedly spun him through the revolving door with no consequences on three gun crimes and multiple felony convictions, including violent crimes.

Malibiran has address and criminal family history in Northeast Minneapolis, as well as north Minneapolis.

Malibiran has nine convictions since 2018, including eight felony convictions*.

*One felony conviction on fleeing police was converted to a gross misdemeanor after Malibiran supposedly “successfully” completed probation. Malibiran was charged in two separate cases with violent crimes while on probation in the fleeing case, so it’s debatable whether he “successfully” completed probation.

Malibiran was originally granted stayed sentences on seven of the eight felony convictions, all in Hennepin County, which included domestic strangulation, receiving stolen property, fifth degree narcotics, two convictions on third-degree burglary, and two convictions on fleeing police.

During the same time, Malibiran was convicted in two cases on gross misdemeanor charges of illegal gun possession. In one case, Malibiran received just probation at sentencing by Judge Tanya M. Bransford. In the other conviction, he was granted a stayed sentence by now retired Judge Martha Holton Dimick.

Malibiran was finally sentenced to prison on his 8th felony conviction on a charge of threats of violence. Under the terms of a plea deal, a charge of first-degree burglary of an occupied dwelling in the same case was dismissed at sentencing. Also dismissed under the plea deal was another entirely separate case charged in Jan. 2021 on a felony count of felon in possession of a firearm.

Malibiran was sentenced in August 2021 to 24 months in prison.

If you’re new to #MNmath, that means Malibiran only served 16 months under Minnesota law that only requires offenders to serve two-thirds of their sentence incarcerated.

Adding insult to injury, when Malibiran was finally sent to prison for the first time on that 8th felony, he was allowed to serve the sentences in four of the other previously stayed felonies concurrently with that sentence.

With credit for 105 days spent in jail, Malibiran was back on the streets in August 2022.

NEW CHARGES

Malibiran has been newly charged in federal court on one count of being a felon in possession of a firearm following a December arrest in north Minneapolis.

Charges originally filed in Hennepin County in the December case say Malibiran was under surveillance as a wanted fugitive when he exited from [a known drug house at] 13xx Irving Ave N with three others and approached a stolen vehicle. Malibiran got into the driver’s seat of the vehicle and fled when officers attempted to stop the vehicle. Officers did not pursue the vehicle at that time.

Police later spotted Malibiran exiting a residence on the 2200 block of Emerson Avenue North and getting into the passenger seat of another vehicle. Officers followed the vehicle to a business parking lot in Northeast Minneapolis on the 200 block of Broadway Street Northeast where the driver fled from the vehicle into a business, and Malibiran was taken into custody.

Upon questioning, the driver of the vehicle told police that his girlfriend had asked him to pick up Malibiran at the Emerson Avenue residence. The driver, identified as a “victim” in the complaint, said he noticed unmarked police cars following them and asked what Malibiran had done. At that point, the victim said Malibiran pointed a gun at him and told him to drive. The driver said he felt he had no choice but to drive and escaped from Malibiran after entering the parking lot.

Police found Malibiran in possession of a firearm as well as a substantial amount of field-tested positive methamphetamine weighing approximately 142 grams, the complaint said.

Malibiran is prohibited from possessing firearms due to his prior convictions on several felony crimes.

Malibiran remained in custody at Hennepin County Jail following the Dec. 7 arrest until Jan. 13, 2023, when he was taken into federal custody under the new federal firearms charge. Malibiran remains in federal custody at this time.
