A tale of repeated MN Courts judicial failure and Public Enemy Minnesota Freedom Fund

Justin Ivan Silva Nicolas, 20, was charged in May 2022 with felony theft in Anoka County, Minn. He was immediately released on zero bail by Judge Nancy J. Logering.
FIVE DAYS LATER he was charged with felony theft in Hennepin County. He was immediately released on zero bail by Judge Lyonel Norris.
At the time of both felony charges, Nicolas had failed to appear in another open case on a charge of recklessly handling a dangerous weapon.
Silva Nicolas failed to show for court four times in the Hennepin County felony theft case, and warrants were issued for his arrest.
Three more times he was released on zero bail after the warrant arrests by judges Rachel Hughey, Luis Bartolomei, and Marta M. Chou.
Silva Nicolas was charged in at least three new cases while out on zero bail including carrying a gun without a permit and two theft cases.
After being arrested on the fourth warrant for failure to appear in the felony theft case, and a warrant for failure to appear the gun/no permit case, bail was finally set at $5,000.
MINNESOTA FREEDOM FUND TO THE RESCUE
Despite failing to appear in court numerous times in numerous cases, Minnesota Freedom Fund thought Silva Nicolas was a good candidate to bail out. MFF paid the $5,000 bail on Dec. 13, 2022, and Silva Nicholas was released from custody.
While out on MFF’s bail, Silva Nicolas was charged this week with first-degree aggravated robbery of a south Minneapolis auto parts store, which we posted about on Feb. 9 as it played out. Charges say Silva Nicholas entered the store with two others, began stealing items, and one of the three tried to stab an employee.
After being pushed out of the store, Silva Nicolas tried to push his way back into the store in a threatening manner.
Justin Ivan Silva Nicolas remains in custody in Hennepin County Jail on $100,000 bail.
William Nicholas Silva, DOB: 06/17/2004, of Minneapolis was also charged with first-degree aggravated robbery in the case and remains in custody on $100,000 bail. A third suspect was unidentified in records.
